The Property Law Act 2023 (Qld) introduces a standardised Seller Disclosure Scheme, requiring sellers to provide a completed Disclosure Statement (Form 2) and all relevant documents before the buyer signs the contract.
The new disclosure package may include:
Title search and registered encumbrances
Notices from local authorities (e.g. flood, environmental, or road works)
Body corporate records (if applicable)
Zoning and planning designations
Unapproved building work or infrastructure
This will be mandatory for most residential property sales from 1 August 2025.
The Risks of Non-Compliance
If a seller fails to disclose required information, provides inaccurate details, or delivers the documents late, the buyer may:
Terminate the contract any time before settlement
